Terms of Service

1. Agreement

By installing or using SeasonAura, or by using this website, you agree to these Terms and our Privacy Policy. If you use the app on behalf of a business, you represent that you have authority to bind that business.

2. The service

SeasonAura provides tools for merchants to configure seasonal visual effects, promotional banners, music, scheduling, and related features on Shopify storefronts via an embedded admin experience and a theme app extension. Features may vary by plan (Free, Pro, Legend).

3. Shopify platform

SeasonAura runs on Shopify. You must comply with Shopify’s terms, policies, and App Store requirements. We are not Shopify; Shopify may change APIs or policies that affect the app.

4. Accounts and installation

You are responsible for maintaining the security of your Shopify store and for authorizing the app’s requested permissions. You must enable the SeasonAura theme app embed for storefront effects to appear.

5. Acceptable use

You agree not to:

• Use the service for unlawful, harmful, or deceptive purposes
• Upload content that infringes intellectual property or privacy rights
• Attempt to reverse engineer, abuse, or disrupt the app, APIs, or infrastructure
• Use effects in ways that impair accessibility, security, or checkout integrity beyond reasonable seasonal decoration

6. Merchant content

You retain ownership of content you upload or configure (promo text, images, audio). You grant us a limited license to host and process that content solely to provide the service. You are responsible for ensuring you have rights to any media you upload.

7. Plans and billing

Paid plans are billed through Shopify Billing. Prices and entitlements are described in the app and on our pricing page. Trials, upgrades, and cancellations follow Shopify’s billing flows. See our Refund & Cancellation Policy.

8. Intellectual property

The SeasonAura name, software, and branding are owned by OClock Software or its licensors. These Terms do not grant you rights except to use the service as permitted.

9. Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, or that effects will display identically on every theme or device.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OCLOCK SOFTWARE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR TOTAL LIABILITY ARISING OUT OF THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE CLAIM (OR USD $50 IF YOU ARE ON THE FREE PLAN).

11. Indemnity

You will indemnify and hold us harmless from claims arising out of your store content, your misuse of the service, or your violation of these Terms or applicable law.

12. Termination

You may stop using the app by uninstalling it from Shopify. We may suspend or terminate access for violations of these Terms or to protect the service. Upon uninstall, shop data is handled as described in the Privacy Policy.

13. Changes

We may update these Terms. Material changes will be reflected by the “Last updated” date. Continued use after changes constitutes acceptance where permitted by law.

14. Governing law

These Terms are governed by the laws applicable in the jurisdiction of OClock Software, without regard to conflict-of-law rules, except where mandatory consumer or merchant protections apply.
